1. Scope of this policy
This policy applies to personal information we handle as a controller — that is, when we decide why and how it is processed. It covers visitors to the Site, prospective clients, clients and their representatives, and business contacts.
It does not apply to personal information we process on behalf of a client under a service agreement (for example, contact details of leads generated for that client). In those cases the client is the controller and its own privacy notice governs; we act as a processor or service provider under the terms of the applicable agreement.
2. Information we collect
2.1 Information you provide
- Identity and contact details — name, business email address, telephone number, company name and role — when you email us or otherwise contact us.
- Commercial information you choose to share about your business, such as your objectives, current operations, volumes, channels or budgets.
- Correspondence and the content of communications between us.
- Contracting and billing details where an engagement begins, including payment information necessary to invoice and receive payment.
2.2 Information collected automatically
- Technical data such as IP address, browser type and version, device type, operating system, language and referring URL.
- Usage data such as the pages you view, the time and duration of your visit and how you navigate the Site.
- Cookies and similar technologies as described in section 5.
2.3 Information from third parties
We may receive information from advertising and analytics platforms, business directories, professional networks and publicly available sources, and from referrals made by mutual contacts or partners.
3. How we use personal information
- To respond to enquiries and provide information about the Services.
- To assess whether an engagement is appropriate and to prepare proposals.
- To negotiate, enter into and perform contracts, including invoicing and calculating commissions.
- To operate, secure, maintain and improve the Site.
- To measure and improve our own marketing, including advertising campaigns run for LCE.
- To comply with legal, tax, accounting and regulatory obligations in the United States and elsewhere.
- To establish, exercise or defend legal claims.
We do not sell personal information, and we do not use personal information for automated decision-making that produces legal or similarly significant effects.
4. Legal bases (EEA, United Kingdom and Switzerland)
Where the EU or UK General Data Protection Regulation applies, we rely on the following legal bases:
- Contract — to take steps at your request before entering a contract and to perform it.
- Legitimate interests — to run and promote our business, to communicate with business contacts, to secure the Site and to prevent fraud, balanced against your rights and freedoms.
- Consent — for non-essential cookies and analytics or advertising technologies where consent is required, and for marketing communications where required by law. Consent may be withdrawn at any time.
- Legal obligation — where processing is required by applicable law.
5. Cookies and similar technologies
The Site uses cookies and similar technologies that are strictly necessary for it to function. Where we use analytics or advertising technologies — including tags or pixels provided by advertising platforms — that are not strictly necessary, we will request your consent where applicable law requires it, and you may refuse or withdraw consent without affecting access to the Site.
Most browsers allow you to block or delete cookies through their settings. Blocking strictly necessary cookies may affect how the Site behaves.
6. Disclosure of personal information
We disclose personal information only as described below, and always under appropriate contractual and security safeguards:
- Service providers acting on our instructions — hosting, email, customer relationship management, analytics, advertising platforms, accounting and payment processing.
- Professional advisers such as lawyers, auditors and insurers, where necessary.
- Clients and partners, where the disclosure is necessary to deliver an agreed engagement.
- Authorities and third parties where required by law, court order or regulatory request, or to protect our rights, safety or property.
- Successors in the context of a merger, acquisition, financing or transfer of all or part of our business.
7. International transfers
We are established in the United States and operate across the United States, Latin America and Europe. Personal information may therefore be transferred to, stored in or accessed from countries whose data protection laws differ from those of your country. Where personal information is transferred out of the EEA, the United Kingdom or Switzerland, we rely on appropriate safeguards such as the European Commission’s Standard Contractual Clauses (and the UK Addendum where relevant), together with supplementary measures where required.
8. Retention
We keep personal information only for as long as necessary for the purposes described in this policy. Enquiries that do not lead to an engagement are generally retained for up to 24 months. Contractual, invoicing and tax records are retained for the periods required by applicable law, typically no less than seven years. Information is then deleted or anonymised.
9. Your rights
9.1 EEA, United Kingdom and Switzerland
Subject to conditions and exceptions in applicable law, you have the right to request access to your personal information; to have inaccurate information corrected; to request erasure; to request restriction of processing; to data portability; to object to processing based on our legitimate interests, including direct marketing; and to withdraw consent at any time. You also have the right to lodge a complaint with your local supervisory authority.
9.2 United States residents
Depending on your state of residence, you may have the right to know what personal information we collect and how we use and disclose it; to request access to, correction of or deletion of that information; to opt out of the sale or sharing of personal information and of targeted advertising; and not to receive discriminatory treatment for exercising these rights. We do not sell personal information and we do not share it for cross-context behavioural advertising as those terms are defined under California law.
9.3 How to exercise your rights
Write to admin@leadconsultingenterprise.com. We will respond within the period required by applicable law and may need to verify your identity before acting on a request. An authorised agent may submit a request on your behalf with proof of authorisation.
10. Marketing communications
We may send business communications about the Services to business contacts where permitted by law. Every marketing email includes an unsubscribe link, and you may also opt out at any time by writing to us. Opting out of marketing does not stop communications relating to an active engagement.
11. Security
We maintain technical and organisational measures appropriate to the risk, including access controls, encryption in transit, least-privilege access and vendor due diligence. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
12. Children
The Site and the Services are directed exclusively at businesses and are not intended for individuals under 18. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us and we will delete it.
13. Third-party sites
The Site may link to third-party websites and platforms. We are not responsible for their content or privacy practices, and we encourage you to read their policies.
14. Changes to this policy
We may update this policy from time to time. The date at the top of this page reflects the most recent revision. Where changes are material, we will take reasonable steps to notify you.
15. Contact
